Terms and Conditions
The terms and conditions offered here constitute the agreement between you and Transporte Fácil E.I.R.L (AKA Gringo Taxis). Booking a taxi and using the service indicates that you have unconditionally accepted the terms and conditions as they are listed in the agreement.
1. Definitions
Gringo Taxi and “we” or “us” refers to the company providing the Reservation Service. The terms “you” and “your” can refer to any person, business or company making a booking with us.
2. English Speaking Driver
2.1 Every effort will be made to provide clients with an English-speaking driver. However, due to the high demand of our service we cannot guarantee the driver will speak more than basic English, or any English at all.
2.2 Spanish-speaking drivers will be used in the event of an unavoidable circumstance such as a vehicle/driver out of service, vehicle breakdown, or a significant change to a flight arrival time. Due to licensing regulations, larger vehicles such as vans, minibuses, and full-size buses will have Spanish-speaking drivers.
3. Booking
3.1 You are required to allocate enough time for the journey to allow you to arrive on time. This includes all airport transfers where you are required to check in at a certain time for your flight. Gringo Taxis will not be responsible for any delay caused by your inability to allocate enough time to reach your destination on time, or if you are not ready to be collected at the allocated time.
3.2 It is your responsibility to order a vehicle of suitable size for all travelers and luggage. Gringo Taxis makes no guarantee to carry an excessive amount of luggage. Please be aware that a child, no matter the age, will be regarded as a single passenger.
3.3 Anyone requiring wheelchair access should request this at the time of booking. Currently, Peru does not have any requirement to provide lift assistance to persons with wheelchairs. We will make every effort to help but do not carry ramps or other equipment to assist.
4. Prices & Payment
4.1 Gringo Taxis provides a quotation based on information provided by you. All prices, unless otherwise stated, are subject to change. If there are any material changes to the stated itinerary, we reserve the right to alter the provided quote.
4.2 Our quote includes a 90-minute waiting period after the stated landing time and the cost of airport parking. Any waiting time beyond this will be charged at the standard Gringo Taxis rate of $10 per hour (or fraction) for sedans, $18 per hour for SUVs, and $20 per hour for vans. Providers will do their best to review flight details and adjust accordingly if delays occur, but are not obliged to do so.
4.3 Upon accepting a quote, you will receive confirmation of the booking. Please review this confirmation and ensure all details are correct. If you do not notify Gringo Taxis of any error, we shall not be responsible for delays or costs that arise from it.
4.4 Gringo Taxis offers the following payment options:
– Full payment can be made securely with a credit or debit card at the time of booking on our website at www.gringotaxis.com.
– Full payment can also be completed via a secure payment link sent to your email, WhatsApp, Messenger, or SMS. If you’ve chosen an email link, please check your inbox and spam folder.
All payment links are valid for 24 hours from the time they are sent. A booking is not confirmed until payment has been received.
To guarantee your ride, payment must be completed in advance. Bookings without payment are considered tentative and may be released without further notice. While we offer flexible payment options, we prioritize confirmed, prepaid reservations. Rides may not be held if payment is not received before your travel date.
4.5 If for any reason you fail to be at the pickup point within a reasonable time after the scheduled collection time, the Provider will attempt to contact you at the mobile number you provided. Your driver will wait 90 minutes after an airport arrival time and 20 minutes at an address pickup.
If we cannot reach you due to an invalid number, no signal, unanswered calls, voicemail, or no response to messages, your ride will be considered forfeited, and no refund will be due.
5. The Service
5.1 You are responsible for the behavior of all passengers in your party. If the vehicle is soiled, damaged, or otherwise negatively impacted by any passenger, a cleaning or repair charge may be applied.
We are not permitted to carry more passengers than is legally allowed by licensing and insurance. Due to COVID-19 regulations, Peru has implemented a 50% capacity limit for all taxis and vans.
6. Waiting Time
For arrival transfers, drivers will wait a maximum of 90 minutes after your actual landing time. All drivers use flight tracking and monitor Lima Airport’s official site.
6.1 For departures, drivers will wait as close as legally allowed to your pickup location. A maximum of 20 minutes will be allowed after the scheduled pickup time. If contact has not been made, the driver will leave and no refund will be issued.
In either case, if you request the Provider to wait beyond the limits stated above, a waiting fee may be applied. If you choose not to pay this fee, the driver has the right to leave.
6.2 Unused transfers are non-refundable. Alternate transportation costs will not be reimbursed.
7. Cancellations
7.1 If you need to cancel a booking, you must contact us as soon as possible. Charges are as follows:
– If the client refuses service at the pickup time, there will be no refund.
– If the client is a “no show” after 90 minutes of waiting at the airport or port with no notice, there will be no refund.
– If the client cancels within 12 hours of pickup time, a 30% cancellation fee applies.
– If the client cancels with at least 24 hours’ notice, a 20% cancellation fee applies.
– In the rare event that Gringo Taxis cancels your service, you will receive a 100% refund (issued within 30 days). Gringo Taxis shall have no further liability in such cases.
Confirmed reservations are only refundable under the terms listed above. Failure to complete payment or be present at the designated pickup time without prior communication is considered a no-show and will not be refunded.
7.2 If you cancel a booking made through our online system before the vehicle has been dispatched, an administrative fee may apply.
8. Liability
8.1 While we do our best to ensure timely arrivals, we are not responsible for delays caused by circumstances beyond our control. You are responsible for allocating sufficient time for your journey.
8.2 Luggage is carried at your own risk.
8.3 If a vehicle breaks down during your journey, we will make every effort to send a replacement vehicle as quickly as possible.
8.4 You are responsible for your own party’s actions. Gringo Taxis will not be held liable for damage or loss arising from actions or omissions of passengers.
8.5 Nothing in these terms excludes liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other matter which cannot be excluded by law.
9. Termination
9.1 Gringo Taxis and its Providers reserve the right to refuse or terminate service without notice if any vehicle or driver is placed at risk due to abusive, violent, or damaging behavior. No refunds will be issued for services terminated under these circumstances.
10. Miscellaneous
10.1 Gringo Taxis may subcontract obligations under this agreement. You may not transfer or assign your rights or responsibilities.
10.2 Gringo Taxis may update these terms at any time by changing this page. Please review regularly for any updates. Existing bookings will be honored under the terms in effect at the time of booking.
10.3 This agreement represents the entire understanding between you and Gringo Taxis.
10.4 Nothing in these terms grants any rights to a third party. No third party has the right to enforce any part of this agreement unless expressly agreed in writing.
11. Fraud and Unauthorized Card Use
11.1 Reservation vs. Ticket Sale
Please note that when you book with Gringo Taxis, you are reserving a transportation service, not purchasing a ticket or seat. Payments made to confirm a reservation are non-refundable, unless otherwise stated in our cancellation policy.
11.2 Unauthorized Use
If you suspect that your payment method has been used without your consent, please contact us immediately. Gringo Taxis will take all reasonable steps to investigate any claims of unauthorized use.
11.3 Disputed Payments
In the rare case of a payment dispute, we ask that you contact us first to resolve any concerns directly. Should a chargeback occur, we reserve the right to investigate and recover any associated costs.
11.4 Payment Responsibility
You are responsible for ensuring that the payment method used for booking is authorized and valid. If someone else uses your payment information without your consent, you remain responsible for the payment.
